Development Notice: Change to non-conforming use – 125 PARK AVENUE
The City has not received any objections concerning this proposal or confirmation of attendance at the briefing session. Hence, the scheduled briefing session for Wednesday, November 15, 2017 has been cancelled.
Briefing Session – 7:00 pm – WEDNESDAY, NOVEMBER 15, 2017 at Mount Pearl City Hall
The City is in receipt of an application by the property owner proposing to expand the second floor of the existing building at 125 Park Avenue by 63 m². The footprint of the existing building will not change. This is to accommodate additional residential living space on the second floor. There is no additional on-site parking requirement as a result of the proposed residential floor area expansion. The City has already issued a permit to renovate the building to continue the combined take-out and restaurant use on the main floor.
The subject property is zoned Commercial – Local (CL) and the proposed “Apartment Over Permitted Use” is an existing use and listed as permitted in this use zone. The existing building does not comply with the building line setback development standard of 6 metres for the CL Use Zone; however the proposed expansion of the apartment does not increase the existing non-conformity. Any change to an existing non-conforming use requires public notification, in accordance with the Mount Pearl Development Regulations 2010. The proposal meets all other requirements of the City of Mount Pearl Development Regulations 2010.
Prior to deciding on this application, Council requests that any person wishing to comment on the application do so in writing. Comments must be received by the City no later than 12:00 noon, Friday, November 10, 2017. Should no submissions or indication of attendance at the briefing session be received by the deadline, the City will cancel the briefing session. A response to this public notice shall form part of the public record. If you do not wish your name attributed to your comment, please advise the City.
